This Acceptable Use Policy ("AUP") governs the use of MMJI CHILLZ, LLC's websites, platforms, and services operating under the Linkstub brand (collectively, "Linkstub"), including but not limited to www.linkstub.com, our event management and ticketing platform, marketing tools, and any related downloadable software made available by Linkstub for use with such services (collectively, the "Services"). "You" and "Your" mean the individual or legal entity accessing and using the Services under an agreement with Linkstub, and any users granted such access and use rights by you. By accessing or using the Services, you agree to comply with this AUP. Terms not otherwise defined in this AUP will have the meaning set forth in the applicable Terms of Service.
The purpose of this AUP is to ensure the responsible and ethical use of our Services, protect the integrity and security of our platform, and maintain compliance with applicable laws and regulations.
A. PROHIBITED ACTIVITY
You agree that You will not:
1. Conduct IP Infringement
Infringe or misappropriate any Linkstub or related third-party copyright, trademark, or other intellectual property, proprietary right, license right, or legal content protection.
2. Conduct Illegal Activities
Violate any applicable laws, rules, or regulations; violate the rights of others; distribute personal or confidential information without securing the necessary rights, permissions, and consents; or encourage or promote activities in violation of any applicable laws, rules, or regulations. This includes but is not limited to laws related to ticket sales, event management, data protection, consumer rights, and anti-discrimination.
3. Perform Malicious Activities
Access, use, store, share, distribute, display, publish, transmit, or send content or promote, support, or facilitate a cause or action that is or could be deemed offensive, harassment, inflammatory, hateful, defamatory, discriminatory, obscene, abusive, invasive of privacy, or harmful to others. This includes distributing unwanted, unsolicited, or harassing mass emails or SMS messages, conducting phishing scams, or transmitting unwanted promotional or commercial content, including spam. You will not take any action that materially interrupts or interferes with, or that might reasonably have been expected to materially interrupt or interfere with or otherwise harm or provide unauthorized access or cause unauthorized modifications to the Service or Linkstub's business operations.
4. Transmit Malware
Transmit into or use with the Services any of the following: viruses, malware, malicious or destructive code, or any other routine, device, or other undisclosed feature (e.g., time bomb, software lock, malicious logic, worm, trojan horse, back door, or software routine) that either interferes with or otherwise harms or provides unauthorized access or causes unauthorized modifications to the Services.
5. Reverse Engineer
Reverse engineer, decompile, disassemble, attempt to gain unauthorized access to, or attempt to discover the underlying source code or structure of, the Services, Linkstub work product, or the technology and software used to provide them, and all intellectual property and proprietary rights therein.
6. Resell or Misuse the Platform
Commercially sell, resell, license, sublicense, distribute, or frame the Service to a third party unless authorized by Linkstub in writing. This explicitly includes creating unauthorized ticket reselling operations that bypass our platform's protections against scalping or unauthorized ticket transfers, when such restrictions have been set by event organizers.
7. Violate the Terms of Service
Access (including through any interfaces provided within the Services) any Linkstub product or service, or other third-party service or website, in a manner that violates the terms for use of, or access to, such product, service, or website.
8. Impersonate Others
Mislead or confuse others by alleging to be someone else or alleging to represent an organization you do not represent. This includes creating fake events, impersonating legitimate event organizers, or misrepresenting your affiliation with venues, performers, or brands. You will not remove, obscure, or cancel from view any copyright, trademark, or other proprietary or confidentiality notice or legend appearing in the Service or Documentation.
9. Create Fraudulent Events or Tickets
Create events with the intent to defraud users, including but not limited to advertising events that do not exist or that you do not have the authority to sell tickets for, creating duplicate or counterfeit tickets, or engaging in any practice designed to mislead ticket buyers about the nature, location, or details of an event.
10. Engage in Abusive Ticket Practices
Use automated systems, bots, scripts, or other technological means to purchase large quantities of tickets, circumvent ticket purchasing limits set by event organizers, or otherwise engage in ticket scalping or price gouging activities.
11. Disparage Linkstub
Access, use, or otherwise exploit the Services for purposes of competing with or disparaging Linkstub or the Services.
12. Circumvent Platform Fee Structures
Attempt to circumvent Linkstub's fee structure or payment processes, including directing users to complete transactions outside of the Linkstub platform after initiating them on the platform.
B. PROHIBITED DATA
Payment Card Industry (PCI) Data
Linkstub implements specific security measures for handling payment information. However, you agree not to submit or store complete credit card numbers, CVV codes, or other sensitive payment card industry data outside of the designated payment processing flows.
Sensitive Personal Information
Unless specifically required and authorized for legitimate event management purposes, you will not collect, process, or store sensitive personal information of attendees, including but not limited to government identification numbers, complete health records, or biometric data.
C. AGE RESTRICTIONS
The Services are not intended for use by individuals under the age of thirteen (13). By using the Services, You represent and warrant that You are at least thirteen years old. If you are between the ages of thirteen (13) and eighteen (18), you may use the Services only with the involvement and supervision of a parent or guardian.
Event Organizers must comply with all applicable laws regarding age-restricted events and must properly indicate any age restrictions within the event details when creating events through our platform.
D. LOCATION OF ACCESS
You are responsible for securing, using, and monitoring an internet connection, which may include a VPN, that is compliant with laws and regulations of the jurisdiction from which you access Linkstub's Services.
You are prohibited from using the Services:
- In a jurisdiction that is subject to a United States government embargo, or that is in Group E of Title 15, Part 740 Supplement 1 Country of the United States Code of Federal Regulations.
- In a jurisdiction that has been designated by the United States government as a "terrorist supporting" country.
- In a jurisdiction that is listed on any other United States government list of prohibited or restricted parties.
- In violation of any other embargo or export restriction.
Unless You have secured express written approval from the applicable governing authority.
E. REPORTED IP ABUSE
To the extent You use the Services to publish or otherwise make available content, You must comply with any notices received under Title II of the Digital Millennium Copyright Act of 1998 (Section 512 of the U.S. Copyright Act) or similar statute in other countries (the "DMCA"). If Linkstub receives a notice alleging that material made publicly available via Linkstub Services infringes or misappropriates another party's intellectual property, Linkstub may take any remedial action it deems necessary.
If You encounter content that You believe violates this AUP, please report it to us using the Report Abuse link on Linkstub's website or by emailing abuse@linkstub.com. Linkstub may but is not obligated to investigate any violation of this AUP or misuse of the Services.
F. VIOLATIONS AND ENFORCEMENT
In addition to any other remedies that may be available, Linkstub reserves the right, in its sole discretion, to take any remedial action it deems necessary, including immediately suspending or terminating Your account or unpublishing any Customer Content to prevent disruption of the Services or to protect the rights and safety of individuals, customers, or Linkstub.
Violations of this AUP may result in:
- Temporary or permanent suspension of your account.
- Removal of events, listings, or content.
- Forfeiture of funds held in your account.
- Restriction of specific features or capabilities.
- Termination of your relationship with Linkstub.
- Legal action, where appropriate.
If Linkstub has, or reasonably suspects based on documented evidence that You have, violated any law or regulation, Linkstub may report such violations to the appropriate law enforcement officials, regulators, or other third parties. Linkstub's reporting may include disclosing relevant user information. Linkstub also may cooperate with appropriate law enforcement agencies, regulators, or other third parties to help with the investigation and prosecution of illegal conduct by providing network and systems information related to alleged violations of this AUP.
G. SPECIFIC PROVISIONS FOR EVENT ORGANIZERS
If you use the Services as an Event Organizer, you additionally agree that:

Event Accuracy: All information related to your events, including but not limited to dates, times, locations, performers, and ticket prices, must be accurate and truthful. Misleading descriptions or bait-and-switch tactics are strictly prohibited.

Legal Compliance: You will obtain all necessary permits, licenses, and authorizations required to lawfully conduct your events, and will ensure compliance with all applicable laws related to public gatherings, venue capacity, alcohol service (if applicable), noise ordinances, and safety regulations.

Cancellations and Refunds: You will adhere to your stated refund policy and will not cancel events without providing reasonable notice to ticket holders and offering appropriate refunds as outlined in your policy and required by applicable law.

Customer Data: You will use attendee data only for the purposes related to your event and in compliance with applicable data protection laws, and will not sell or misuse such data.

Marketing Communications: You will comply with all applicable laws governing marketing communications, including obtaining proper consent for SMS and email marketing, and honoring opt-out requests promptly.
H. SPECIFIC PROVISIONS FOR TICKET BUYERS AND ATTENDEES
If you use the Services as a Ticket Buyer or Attendee, you additionally agree that:

Accurate Information: You will provide accurate information when purchasing tickets or registering for events.

Ticket Limitations: You will respect ticket purchasing limits set by Event Organizers and will not attempt to circumvent these limits through multiple accounts or other means.

Ticket Transfer and Resale: You will comply with any restrictions on ticket transfers or resales established by Event Organizers or required by law.

Event Attendance: You will comply with all venue rules and regulations when attending events, and understand that Linkstub is not responsible for the conduct of Event Organizers, venues, or other attendees.
I. REVISION TO THIS POLICY
Linkstub may revise this AUP from time to time to reflect changes to technologies, industry practices, regulatory requirements, or as we deem necessary. Any such revision will be effective upon renewal of your agreement with Linkstub after publication of the updated AUP to Linkstub's website, or with reasonable notice if the changes significantly affect your use of the Services.
By using Linkstub's Services, you acknowledge that you have read, understood, and agree to be bound by this Acceptable Use Policy.
